These Terms & Conditions will be applied completely and affect your use of this Website. By using this Website, you agree to accept all terms and conditions mentioned here. You must not use this Website if you disagree with any of these Website's Standard Terms and Conditions.
The Client shall cooperate with the American Web Factory and provide all necessary information, materials, and access to resources required for the provision of the Services. The Client shall also provide timely feedback and approvals throughout the work process.
The Client shall pay the American Web Factory the fees set forth in the state of work (SOW) or proposal. In the event of late payment, the American Web Factory reserves the right to suspend or terminate the Services.
The American Web Factory shall retain all intellectual property rights in any designs, code, software, or other deliverables created in connection with the Services unless otherwise agreed to in writing by both parties. The Client shall have a non-exclusive, non-transferable license to use such deliverables for its internal business purposes only.
The parties agree to maintain the confidentiality of any confidential information disclosed by one party to the other in connection with the Services. The American Web Factory shall take reasonable measures to protect the confidentiality of the Client's confidential information.
The American Web Factory represents and warrants that the Services will be performed in a professional and workmanlike manner, consistent with industry standards. The Client represents and warrants that it has the legal right to provide any materials or information provided to the American Web Factory in connection with the Services.
The American Web Factory shall not be liable for any indirect, consequential, special, or punitive damages arising out of or in connection with the Services, whether in contract, tort, or otherwise, even if advised of the possibility of such damages. The American Web Factory's total liability for any claim arising out of or in connection with the Services shall not exceed the total fees paid by the Client under the SOW or proposal.
Either party may terminate the Services for any reason upon written notice to the other party. In the event of termination, the Client shall pay the American Web Factory for all services performed prior to the termination date.
In case of filing a complaint, American Web Factory will try and come to a mutually acceptable solution if a user is unsatisfied with any of our services. Revocation occurs when things don't work out. If You think about filing a claim, please write to us before launching a request.
You should only file complaints if we are unable to affect a mutually satisfactory solution.
We handle every project in a professional manner to ensure that the client is delivered what was mentioned as per the terms and conditions of the proposal. Certain conditions apply to a refund.
If the initial design concepts are approved, or a revision is required, any deposited fees for a project will not be refunded after delivery unless American Web Factory cancels or terminates your Contract for a reason other than your breach or non-performance.
All refund requests will be processed according to the following procedure:
When the initial Web concepts are presented, you make a request. The refund offer becomes void after you approve or request revisions to the first drawings, and your refund request will be ignored.
If you request a refund before the initial design concepts are delivered, you will be eligible for a full refund (less 10 percent service & processing fee).
If you submit your refund request within 48 hours, you will receive a 66 percent refund (less 10 percent service & processing fee).
If you request a refund between 48 and 120 hours after receiving the initial design, you will receive a 33 percent return (less 10 percent service & processing fee).
After 120 hours, no refund requests will be considered; however, because we strive for 100 percent customer satisfaction, you are urged to contact us if you have any concerns.
If you have not taken any action on your order for 30 days after ordering it, you will not be eligible for a refund. If you wish to reactivate your design order, you'll have to pay a price that varies based on the project.
After the final files have been given, no refund requests will be considered.
If a customer is satisfied with the project but requests a refund due to a change of mind or other personal concerns throughout the project, the client is not eligible for a refund.
Once the website creation has been done and the website has been launched live, there will be no refunds available.
After the storyboard has been designed, no refund requests for video animation packages will be considered.
All refund requests should be sent to the customer service department. Based on the violation of your user agreement, American Web Factory retains the right to grant or refuse your request on an individual case-by-case basis.
The return policy for American Web Factory / Custom packages will be the same as it is for single packages.
For example, if you order a logo and web design service and approve the logo, you can only get a refund for the American Web Factory service.
A good justification must be provided for a refund request, which must be evaluated against the design brief and client feedback for modifications.
A refund will not be issued unless the concept is not designed according to the brief; nonetheless, more changes will be supplied until perfect satisfaction is achieved.
Money back guarantee is based on that the order is placed in good faith. Where a customer has placed design orders with more than one design agency for the same job to claim a refund, we do not consider it in good faith. In such a case we reserve the right to decline a refund request.
All design jobs require customer feedback before finalizing the design therefore it is only fair that the customer gets involved and provides feedback to get the desired results.
Any resemblance to an existing design will be merely a coincidence and The American Web Factory will not accept any responsibility or claim of any compensation in such a case. It is the client's responsibility to get their artwork copyrighted.
Note: The American Web Factory hold all the rights to reject any project or cancel the contract whenever it deems necessary. After the refund,
you will not have any rights to use the designs for any purpose; they will be the sole property of The American Web Factory. The company will
be the rightful owner of the designs.
Services not related to design services are not eligible for refunds under any circumstances. They are not covered under our 100% money-back guarantee. If such a service is acquired as part of a Package Deal of any kind, it cannot be used to request a refund on the entire package.

For services that are not covered under the 100% refund policy in case of dissatisfaction with the American Web Factory management after review, the project may choose to offer a partial refund to the client.
There are no refunds for any rush service charges. In case of refund approval, the client will get his amount credited back within the next 12-15 Business Days. We won't entertain or refund any orders if the client stays non-responsive for 45 Days, but the client can send us an email to hold the project if there is some personal issue. Also, if the client is non-responsive for more than 45 Days, then the client has to pay an extra caution fee for re-initiating the project.
In case the client wants to forfeit the services after 25 days, a refund won't be applicable, though we can hold the project in such case, and the client can come later and get the project started again.
The American Web Factory offers refunds for services availed directly from the Company website or sales team, subject to the terms and conditions outlined in this Policy.
The American Web Factory offers two types of refunds:
To request a refund, the Client must contact the American Web Factory's customer service department by email. The Client must provide proof of purchase, a reason for the refund request, and any additional information requested by the Company.
Upon receipt of the refund request, the Company will review the request and determine eligibility for a refund. If the refund is approved, the Company will initiate the refund process within 5 to 7 business days of approval.
The American Web Factory reserves the right to modify this Policy at any time without prior notice. The current version of the Policy will be posted on the American Web Factory's website.
